    תקכז. וששאלת על ראובן שעירער על שמעון על שהוציא זיזין מביתו לרה"ר ונתחייב שמעון בב"ד להסיר הזיזין שלו אם [זכו] בזה כל בני רה"ר אע"פ שלא בא בהרשאתם דבר פשוט הוא שזכו כולם אפי' הנך דליתנהו במתא בההיא שעתא דזכין לאדם שלא בפניו אבל אם לא הי' ראובן זוכה בדין כנגדו נהי דהנך [דאיתנהו] במתא איבעי להו למיתי אי אודיענהו שרוצה לטעון [וכיון דלא אתו הפסידו] כדאי' ס"פ מי שהי' נשוי (צד ע"א) מיהו הנך דליתא במתא או אפי' הנך דאי' במתא ולא אודיענהו יכלי למימר אי הוינן התם הוי טעני' שפיר טפי ואם הם טענו כך נתחייבנו בלא ידיעתינו אין חבי' לאדם אלא בפניו.

    (1) Q. A demanded that B saw off the beams extending from his house into the street. The court decided in A's favor. Are the other members of the community entitled to the benefits of the court's decision?
    A. All the members of the community, even those who were absent from the town at the time of the trial, are entitled to the benefit of the court's decision, even though A did not act as their representative. But, had the court decided against A, such decision would be binding only on A and on all those who knew about the trial, while all those who were out of town at the time, or who were in town but did not know about the trial, would not be bound by such decision and would still be able to press suit against B.
    (2) Q. The court did not specify in its written decision (see above) the name of the plaintiff nor the location of the beams that were to be sawed off.
    A. The decision states that B must saw off his beams; therefore, the identity of the plaintiff is not important. The judges are permitted to testify as to the beams to which their decision refers.
