וששאלת על הטבח שהוציא (ראובן) ירכות ונמצאת באחת תלתלים אם יש לתלות בשגגת הבודק או בגוי שמא החליף ונטל של כבש טרפה בשחוטה אי איכא למתלי תלינן דהא תלי' בזאב ותלי' בנקב שבריאה היכא דמשמש ידא דטבחא דנשחטה בחזקת היתר עומדת וכו'. ושלום מאיר בר' ברוך זלה"ה.
Q. A butcher removed the lungs from several ritually slaughtered sheep. Later, adhesions were found on one of the lungs. Are we to suspect that the ritual examiner had been at fault and had overlooked these adhesions, or are we to presume that a Gentile had mixed a lung from a trefah sheep with the other lungs? A. Whenever a presumption is possible we resort to it, since a ritually slaughtered animal is considered kosher until it is proven to be trefah. SOURCES: B. p. 291, no. 363.
