ועל ראובן ושמעון שעברו על תקנת הקהל וקנסו אותם בכך וכך לתן בצדקה ויש ב' בתי כנסיות בעיר וראובן הולך לביהכ"נ זו ושמעון לזו והבתי כנסיות אינם שוי'זו מועטלת וזו מרובה היאך חולקי' לפי נפשות או בשוה דבר זה תלוי בדעת הקהל ובמנהג היאך רגילי' לחלוק הצדקות והקנסות ואי ליכא מנהגא והקהל אין יכולי' להשוות דעתם נ"ל דחולקי' לפי נפשות אביונים נקיים שבעיר חלק כחלק כדגרסי' בתוספתא דב"ק (פי"א) האומר תנו מאה דינרי' לביהכ"נ תנו ס"ת לביהכ"נ ינתנו לביהכ"נ הרגיל בה ואם הי' רגיל בשניהם ינתנו לשניהם האומר תנו מאה דינרי' לעניים לעניי אותה העיר וכו' והקהל קונסי' הכא לצדקה דהיינו לעניים הלכך ינתנו לעניי אותה העיר בשוה לפי נפשות מצינו חילוק בין ענייך לעניי עירך בין עניי עיר זו לעניי עיר אחרת אבל בין עניי ביהכ"נ זו לבני ביהכ"נ אחרת שבעיר זו לא אשכחן חלוק.
Q. A and B transgressed a community ordinance and a fine was imposed on them to pay a certain amount to charity. There are two synagogues in town, however, one having a large membership and the other a small membership. A frequents one synagogue, while B frequents the other. Must the fine-money be equally divided between the two synagogues, or must it be distributed in proportion to their respective memberships? A. The distribution of charity and fine-money is governed either by custom or by agreement on the part of the community (members). However, if no custom exists in your town and the community can come to no agreement, the money should be distributed in proportion to the number of charity recipients belonging to each synagogue; for A and B were ordered by the community to pay to charity, and all the poor of the town have an equal claim to the charity of that town. A distinction is drawn in Jewish law between the poor related to the donor and the poor of the town, between the poor of the donor's town and those of another town.
