וששאלתם כל בע"ח וכתו' אשה הי מיניהו דים לגבות בנכסי המת נ"ל דל"מ היכא דאיכא כדי לזה ולזה אלא אפי' ליכא אלא לחד מיניהו יהבי' לבע"ח ולא לאשה כמ"ש רב אלפסי בפ' הכותב אמלתא דאמימר האי מאן דאית עלי' כתו' אשה ובע"ח וליכא אלא כדי חד מיניהו וכו' דמטלטלי בזה"ז שתקנו הגאוני' דבע"ח וכתו' אששה גובי' מהם לית בהו דינא דקדימא דלא גבי מטלטלי דמשעבדי אלא מב"ח לבע"ח יהיבנ' ולא לאשהלא כמ"ש בשערים שלו בשער י"ט דבע"ח ואשה חולקי' כל א' לפי חובו וגם כתב שרב האי כתב דלבע"ח יהבי' ליה.
Q. A widow demands her ketubah and a creditor demands his money from an estate. Who has priority in collecting from the estate? A. The creditor has priority over the widow. Moreover, even when the estate consists of assets only to satisfy one of the claimants, the creditor is paid in preference to the widow.
