כי הוינא בדינא דמורדת לא מסקי' אלא כדמסיק תעלא מבי כרבא כי רבו בה דייני דינא דמתני' דינא דגמרא ודינא דמתיבתא ועוד הציבו לה ציונים אחרונים ואנו אחרונים יתמי דיתמי לא ידענא איך נפתח פה לפניכם הר' יעקב והר' יוסף שיחי' על דבר מורדת ואמרה מאיס עלי כך כתוב בתשו' הגאונים דנ"מ יהיב לה בעל אי איתנהו בעיניהו ואי ליתנהו בעיניהו לא נסיב לה ונצ"ב אפי' אי ליתנהו בעיני' כגון שכלו לגמרי או מגנבו באחריותי' קיימי ומשלם לה דמיהם וכן אנו נוהגים. ומה שתמהתם היכא דחזקאי דמתמוטטי נכסי תמרוד ותתפוס בנכסיו ותאכל היא ותחדי והוא יחזור על הפתחים לאו חדוה שלימה היא אחרי שהרשות בידו לעגנה ונהי שגם הוא מתעגן בדורות הללו מתקנת ר"ג זי"ע מ"מ איהי נמי מעגנא וכ"ש לדברי ראב"ן ז"ל שמתיר לבעל לשא אחרת והיא תתעגן.
Q. How are we to treat a rebellious wife, who asserts that she despises her husband? A. She is to receive whatever she has brought in to her husband as dowry (Nikse Zon barzel), and whatever is left of her own property to which her husband has had the right of usufruct (nikse melug). She is, then, to wait until her husband consents to divorce her. Your objection to this procedure on the ground that any woman upon seeing her husband losing his property and sinking into poverty would become a rebellious wife, seize his remaining property and enjoy its use, is not very serious as she would not enjoy it very much, for, her husband may refuse to divorce her.
