Q. A claims that B owed him three and three-eighths marks, that B gave him valuables to pledge with the charity treasurers for a loan of the same amount (the money of which A was to take in payment of the above debt), that B asked him to pledge with the charity treasurers additional valuables of his own, which he (A) was to lend to B, should B's valuables prove insufficient security for the loan, and that B promised to redeem these valuables. A, therefore, demands that B redeem his pledges. B, while conceding the above, claims that originally A lent him only three marks; that the additional three-eighths of a mark A is demanding, constitutes the interest on this loan; and that such interest is unlawful usury from Jew to Jew since the loan was made by A directly to him [without a Gentile intermediary]. A. B must take an oath that the three-eighths of a mark constitutes interest on a loan made directly to him, and thus be free from obligation for this sum. Although by taking this oath B will incriminate himself [since borrowing money on interest is also a sin] such oath will have full legal effect when applied against A.
