תתמא. וששאלת אנשים שנשבעו ביניהם בגזירה חמורה לסייע זא"ז מיד אחרי' והאחד יוצא מתנאי השבועה אם חבירו פטור מלשמור שבועתו אע"פ שלא נשבע לו [בתנאי] ע"מ שתשמור לי אשמור לך יודיע הרב אל השואל אם יפטור או ע"י הרב או בענין אחר [שהשבועה] שנשבע על אימת שופכי דמים ומלשינים נשבע נראה אם נתחרט זה על שבועתו על שלא עמד חבירו בשבועה יבא לפני ב"ד הדיוטות או [יחיד] מומחה וישאל על נדרו ויאמר אדעתא דהכי לא [נדרתי] ויתירו לו נדרו.
Q. A and B entered into an agreement and bound themselves by a severe oath, to help each other against murderers and informers. A failed to carry out the terms of the agreement. Does A's breaking of the agreement absolve B from his oath and release him from his obligations to A? A. Three laymen may absolve B from his oath on the ground that it was his expectation, at the time he bound himself to the terms of the agreement, that A would carry out his part of the obligation.
