צז. אלופי ומיודעי הר' אלעזר כהן. בקצרה אשיב כי יש בירושלמי (פ' אע"פ ה"א) פסיקתא דרב גידל כמה אתה נותן לבנך כך וכך כמה אתה נותן לבתך כך וכך דוקא כשהאב פוסק אבל אם שאר קרובים [פוסקים] לא ואפי' אב נמי לא אמר' אלא בנישואין ראשוני' מיהו אם אחותו היתה ענייה כשפסק לה אז הוא ]חייב] משום צדקה [דאמרי' ר"ה ו' ע"א] בפיך זו צדקה וממשכנין על הצדקה דלא יהו אלא אחר כדאמר בירושלמי אבל לעני נעשה נדר. ושלום מאיר בר' ברוך.
Q. A (verbally) promised to give a definite amount of money to his sister upon her marriage. After her marriage A refused to keep his promise. Can A's sister enforce his promise? A. Only a father's verbal promise to his child on his first marriage is binding. All other promises of marriage gifts are not binding unless accompanied by a kinyan (a formal binding act).
