וששאלת על ראובן ושמעון שנמלטו מן התפיסה וחובותיהם שמה אם חייבי' במס. אם הורגלו להיות שותפי' במסים שאין להם קצבה חייבי' גם הם כמו האחרי' וכדפי' לעיל דמיד כשנרמו להם נתחייבו ושוב מי הפקיע מהם. ועוד נוהגי' בכל המלכות שאם יש ליחיד דין ודברי' עם הקהל עבור המס שהוא צריך ליתן המס תחלה ואח"כ יתבע הקהל לדין כי הקהל רוצים להיות מוחזקי' בכל שעה וראי' אני מביא להם מהא דאמר' פ' איזהו נשך (בבא מציעא ע"ג ע"ב) מוהרקייהו דהני בטפסא דמלכא מונח וכו' ודינא דמלכותא דינא. ועוד כיון שכל הקהל שותפי' במס שותף אינו חולק שלא לדעת חבירו ורשאי' בני העיר להסיע על קיצותן כ"ש לגבות קודם המס והבא לשנות עליו הראי'.
Q. A and B, former residents of T, escaped from the prison (where the other Jews of T were held), but their investments have remained in the hands of residents of T. Are A and B obliged to participate in the payment of the ransom money levied on the Jews of T? A. If the Jews of T were accustomed to be partners in the payment of exorbitant taxes, A and B must pay their share of the aforementioned tax. The obligation to pay that tax was created at the time they were all cast into prison, and after that A and B could no longer free themselves from such obligation. SOURCES: Am II, 130.
