ואשר שאלת ראובן רצה למכור את ביתו שהחזיק בו כמה שנים. ושמעון מחה בידו לאמר יש לי עליו טענה. וראובן אמר ארד עמך לדין. ושמעון אמר איני חפץ עכשיו. אך לכשאחפוץ וכו'. עבור דברים כאלה הורגלנו בכל מלכותינו שכל מי שמוכר קרקע מחרימין בבית הכנסת על כל היודע שום ערעור על קרקע זה שיגיד לפני טובי העיר קודם שיצא מחצר בית הכנסת. ואחרי שמדקדקים בערעורים ורואין בהן שאין בהם ממש. כותבין כך וכך החרמנו ביום פלוני ולא יצא לא קול ולא טענה על קרקע פלו' ומעכשיו זיכינו פלוני באותה קרקע. ואם יבא מכאן שום אדם שהיה כאן באותה שעה ויערער עליו לא יהא ממש בדבריו. ולא יהא אדם רשאי לזקק לדין זה:
Q. A is seeking to sell his house of which he was the undisputed owner for many years. B, however, restrains A from selling the house by insisting that he has a claim on it. A is ready to answer B's claims in court immediately, but B refuses to proceed now, and says that he will press his case whenever he chooses to do so. A. In order to obviate such abuses, we are accustomed throughout the kingdom, whenever a person sells his real property, to pronounce the ban in the synagogue against anyone who has any claim on such property and does not report it to the worthies of the community before he leaves the synagogue court. After all claims have been carefully examined and found to be baseless, a document is handed to the buyer wherein is written that on a specified date a ban was pronounced in the synagogue and said property was found to be clear of any encumbrance; consequently we have confirmed the buyer in the ownership of this proerty, and henceforth any claim against it that will be raised by a person who was present at the time the ban was pronounced, shall be null and void, and no one shall be permitted to attend such claim in a judicial capacity.
