על אפטרופוס של אשה שטען על בעלה שהוא תפס בגדיה ואינו חפץ להחזירם לה. והוא השיב שבתורת משכון באו לידו. אם אין הבגדים בידו לא מהימן למימר הכי דדמו לדברים העשויין להשאיל ולהשכיר ואמר לקוחין הן בידי אינו נאמן דליכא מיגו. הכי נמי וכל שכן כיון שבגדיה הם תדיר אצלו לא מהימן למיטען הכי. אבל אי ליכא ראה מהימן דמגו דאי בעי אמר אינם בידי כדמשמע בשמעתתא דאומן.
Q. L's representative claims that her husband has seized her garments and refuses to return them. L's husband avers that the garments were deposited with him as security against a debt. A. If the garments are not now in the husband's possession, or if they were identified in his possession as L's garments, he must return them to L, for a wife's garments are in the category of objects that are usually lent or rented out, regarding which one may not claim that he has bought them (Sheb. 46b). If no one, however, saw the garments in the husband's possession, we uphold his claim; since if he wanted to lie he could have denied having taken them.

וטען האפטרופוס שלקח תכשיטיה כסף וזהב ואינו חפץ להחזירם לה. והשיב הבעל שקבלם בנדוניא חייב להחזירם לה שתשמש בהן. דכיון דהכניסם לו כלי כסף וזהב אע"פ ששמה אותן בנדוניא משתמשת בהם דאדעת' דהכי הכניסה לו כלים ושמאתן בנדונייתה ולא הכניסה לו כספים עצמן להשתמש בהן. וכדמפרש בירושלמי דלהכי הוא פוחת חומש דשמין דעתה של אשה ודעתה להשתמש בהן ולבלותם. וכן משמע בגמרא פרק מציאת האשה בשמעתתא דזהב הרי הוא ככלים (דף טז) ושלום מאיר בר ברוך:
