    שאילו רבנן דבקירואן לבבא דמתיבתא לבי דינא דמרנא רבנא שרירא בריה דרבנא חנניה ברי' דרבנא יהודה ואתו הני שאילות בית דינא דמרנא ורבנא האיי דיינא דבבא ברי' דרבנא שרירא ריש מתיבתא:

    The Rabbis of Kairouan (קירואן) asked the gate of the Yeshiva, to the court of our master Rabana Sherira (רבנא שרירא), son of Rabana Hananya (רבנא חנניה), son of Rabana Yehuda (רבנא יהודה). And these are the questions that came before the court of our master and Rabana Hai (רבנא האיי), the judge of the gate, son of Rabana Sherira, head of the Yeshiva:

    דשאלתון היך נכתבה המשנה אם אנשי כנסת גדולה התחילו לכתוב וכתבו כל חכמי הדור מקצתה עד שבא ר' והשלימה. ו[ש]שאלתם התוספתא ששמענו שר' חייא כתבה אם לאחר המשנה נכתבה אם בזמן אחר. ומה ראה ר' חייא לכותבה אם לתוספת דברים שהם עניני המשנה אמאי לא כתבה רבי. ועוד רבנן סבוראי כיצד נסדרו:

    Regarding what you asked: How was the Mishnah (משנה) written? Did the Men of the Great Assembly (אנשי כנסת גדולה) begin to write it, and the sages of each generation write a portion of it, until Rabbi (רבי) came and completed it? And you asked regarding the Tosefta (תוספתא), which we heard that Rabbi Hiyya (רבי חייא) wrote: Was it written after the Mishnah, or at another time? And what did Rabbi Hiyya see fit to write it—if it was to add matters that are the subjects of the Mishnah, why did Rabbi not write them? And furthermore, how were the Saboraic Rabbis (רבנן סבוראי) ordered?

    תשובה. הכי חזינא דשיתא סדרי רבינו הקדוש תרצינון. ובגמרא דיבמות בהבא [על יבמתו] אמרי' אמר רבא מתניתין אימת איתקין ביומי ר'. ורוב החכמים ששמותיהן מפורשין רבי מאיר ורבי יהודא ור' יוסי ור' שמעון כולן תלמידי ר' עקיבא הן. והכין הוה מילתא דראשונים לא איתודעו שמותיהן אלא של נשיאים ושל אבות ב"ד בלבד משום דלא הוה בהון מחלוקת אלא טעמי דאוריתא ודמשנה הוו ידעי להו ידיעה ברורה. וכמה דהוה בית המקדש קיים כל חד מן רבוותא מגמר לתלמידיה מילי ברורין משום דחכימן ולא הוו צריכין לטירחי דהוה פלוגתא דסמיכא לחוד ביניהון.

    Answer: This is how we see it, that our Holy Rabbi (רבינו הקדוש) arranged the six orders. And in the Gemara (גמרא) of Yevamot (יבמות), regarding "one who has relations with his sister-in-law," we say: Rava (רבא) said, "When was the Mishnah established? In the days of Rabbi." And most of the sages whose names are explicitly mentioned—Rabbi Meir (רבי מאיר), Rabbi Yehuda (רבי יהודה), Rabbi Yose (רבי יוסי), and Rabbi Shimon (רבי שמעון)—are all students of Rabbi Akiva (רבי עקיבא). And thus was the matter: the early ones were not known by their names, except for the Nesi'im (נשיאים) and the heads of the court (אבות בית דין) alone, because there was no dispute among them; rather, they knew the reasons of the Torah and the Mishnah with clear knowledge. And as long as the Temple stood, each of the rabbis taught his students clear matters, because they were wise and did not need the exertion of debate, and there was only the dispute regarding the laying of hands between them.

    ובג' מקומות בלבד נחלקו שמאי והלל ושמאי והלל בפני הבית כמפורש ביציאת שבת. וכד חרב בית המקדש ואזלו לבית תר משום הנך שמדות וצרות שלא שמשו כל צרכן נפישו מחלוקת בישראל. ועד סוף יומין דרבנן ליכא דכתיב מדעם כל עיקר ואע"פ שכל החכמים כולן שוין כל אחד ואחד שונה לתלמידו באיזה לשון שירצה יש מהן שאוחז דרך קצרה ויש מהם שונה דרך ארוכה. וכיון דחזא ר' דאיכא שינויא כולי האי וחזא אע"ג דטעמיהון לחדא מילתא סלקין חש דלא אתי פסידא הואיל וחזא דקא ממעט ליבא וקא מסתמן מיליה מעיינות חכמה ומסתלק שר של תורה כההיא דאמר ר' יוחנן לבן של ראשונים כפתחו של אולם אחרונים כפתחו של היכל

    And in only three places did Shammai (שמאי) and Hillel (הלל) disagree, and Shammai and Hillel were in the presence of the Temple, as explained in the exit of Shabbat (שבת). And when the Temple was destroyed and they went to Beitar (בית תר), due to those persecutions and troubles, and because they did not serve their masters sufficiently, disputes multiplied in Israel (ישראל). And until the end of the days of the Rabbis, nothing was written down at all. And even though all the sages were entirely equal, each one taught his student in whatever language he wished: some took a short path, and some taught via a long path. And when Rabbi saw that there was so much variation, and he saw that even though their reasons amounted to the same thing, he was concerned lest a loss occur. Since he saw that the heart was diminishing, the wellsprings of wisdom were being blocked, and the angel of Torah was departing—as Rabbi Yohanan (רבי יוחנן) said: "The hearts of the early ones were like the opening of the Ulam (אולם), and the later ones like the opening of the Heichal (היכל)."

    ואמרינן ראשונים ר' עקיבא ואחרונים ר' אלעזר בן שמוע. ואחסונוהי לר' מן שמיא בהדי תורתו גדולה דכייפין ליה כוליה דריה כדאמרינן מימות משה ועד ר' לא מצינו תורה וגדולה במקום אחד. ושקטיה רבנן ביומיה מכל שמד משום רחמותא דאנטונינוס. ומכאן ואילך לא גריס אינש כל חד לישנא לנפשיה:

    And we say the early ones are Rabbi Akiva, and the later ones are Rabbi Elazar ben Shammua (רבי אלעזר בן שמוע). And greatness in Torah was granted to Rabbi from Heaven, along with his Torah, such that his entire generation bowed to him, as we say: "From the days of Moshe (משה) until Rabbi, we have not found Torah and greatness in one place." And the rabbis had quiet in his days from all persecution due to the friendship of Antoninus (אנטונינוס). And from then on, no one learned each in his own language for himself.But those early ones before the destruction of the Temple did not need to prepare this, since the Oral Torah (תורת פה) is like a person who speaks to his friend in whatever language he wishes. But before that, they would learn everything by rote, and they all agreed to one opinion, and there was no dispute between them, as Rabbi Yose taught: "Initially, there was no dispute in Israel, but the court of seventy-one sat in the Chamber of Hewn Stone (לשכת הגזית), and two courts of twenty-three... sat in all the cities of Israel. If the matter needed to be asked..." and so on, until the students of Shammai and Hillel multiplied, who had not served their masters sufficiently, and disputes multiplied in Israel, and the Torah became like two Torahs. And when Rabbi saw this, he wrote the Mishnah so it would not be forgotten. And Rabbi did not compose it from his own heart, but rather the matters that the early ones before him used to study.

    אבל הנך ראשונים דקמי חורבן הבית לא איצטריכו להכין הואיל ותורת פה היא כאדם שמספר לחבירו באיזה לשון שירצה. אבל מקודם לכן היו גורסין הכל בגירסא וכולן לדעת אחת היו מסכימין ולא היה המחלוקת ביניהם כדתניא לו ר' יוסי בתחילה לא היה מחלוקת בישראל אלא בית דין של שבעים ואחד יושבין בלשכת הגזית ושתי בתי דינין של כ"ג ואחד [יושב על פתח הבית ואחד יושב על פתח עזרה ושאר בתי דינין של כ"ג] יושבין בכל עיירות ישראל הוצרך הדבר לשאול וכולה עד משרבו תלמידי שמאי והלל שלא שמשו כל צרכן רבו מחלוקת בישראל ונעשית תורה כשתי תורות. וכשראה רבי כן כתב המשנה שלא תשתכח ולא מליביה חברינון ר' אלא מילי דהוו גריסן להו קצת ראשונים דקמי':

    But those early Sages before the destruction of the Temple did not need this preparation, since the Oral Torah (תורת פה) is like a person conversing with his friend in whatever language he wishes. However, prior to that, they would recite everything exactly as it was formulated, and they all agreed upon a single opinion, and there was no dispute among them. As Rabbi Yose (ר' יוסי) taught: Initially, there was no dispute in Israel (ישראל); rather, the court of seventy-one sat in the Chamber of Hewn Stone (לשכת הגזית), and two courts of twenty-three—one sitting at the entrance of the Temple Mount and one sitting at the entrance of the Courtyard—and other courts of twenty-three sat in all the cities of Israel. If a matter required inquiry... and so on, until the students of Shammai (שמאי) and Hillel (הלל) multiplied. Because they did not serve their masters sufficiently, disputes multiplied in Israel, and the Torah became like two Torahs. And when Rabbi (רבי) saw this, he wrote the Mishnah (משנה) so that it would not be forgotten. Rabbi did not compose it from his own heart, but rather these were the matters that the early Sages before him used to study.

    והא דאמרינן סתם משנה כרבי מאיר לאו דר' מאיר מלבו אמרן וההוא אורחא דהוה ר' מאיר מתני לתלמידיה אותה אחז ר' וקבעה לאתנויי לכולי עלמא ור' מאיר [אחז] מר' עקיבא אותו הדרך דאמר ר' יוחנן סתם מתניתין ר' מאיר סתם תוספתא ר' נחמיה סתם סיפרא ר' יהודא סתם סיפרי ר' שמעון וכולהו אליבא דר' עקיבא ועליה דר' עקיבא אמרינן לבן של ראשונים כפתחו של אולם.

    And that which we say, "An anonymous Mishnah is Rabbi Meir (רבי מאיר)," it is not that Rabbi Meir said them from his own heart, but rather that path which Rabbi Meir used to teach his students, Rabbi (ר') adopted and established it to be taught to everyone. And Rabbi Meir adopted that path from Rabbi Akiva (ר' עקיבא), as Rabbi Yohanan (ר' יוחנן) said: "An anonymous Mishnah is Rabbi Meir, an anonymous Tosefta (תוספתא) is Rabbi Nehemiah (ר' נחמיה), an anonymous Sifra (סיפרא) is Rabbi Yehudah (ר' יהודא), an anonymous Sifrei (סיפרי) is Rabbi Shimon (ר' שמעון), and all of them are according to Rabbi Akiva." And concerning Rabbi Akiva we say, "The heart of the early Sages is like the entrance of the Ulam (אולם)."

    בפרק קמא דערובין אמרינן אמר ר' יהושע בן לוי כל מקום שאתה מוצא משום ר' ישמעאל א' תלמיד אחד לפני ר' עקיבא אינו אלא ר' מאיר ששימש את ר' ישמעאל ואת ר' עקיבא. וכן בעלמא אמרי' אמר רב האי דמחדדנא טפי מחברייא דחזיתיה לרבי מאיר מאחוריה אילו חזיתיה מקמיה הוי מחדדנא טפי. תנא לא ר' מאיר אלא ר' מייאשא שמו ולמה נקרא שמו ר' מאיר שהיה מאיר עיני חכמים בהלכה ולא ר' נהוראי שמו אלא ר' נחמיה שמו ואמרי לה ר' אלעזר בן ערך שמו ולמה נקרא שמו ר' נהוראי שמנהיר עיני חכמים במשנה. ואמרי' דאפילו אדם הראשון שמח בתורתו של ר' עקיבא כשהראהו הקב"ה דור דור וחכמיו.

    In the first chapter of Eruvin (ערובין) we say: Rabbi Yehoshua ben Levi (ר' יהושע בן לוי) said, "Wherever you find 'in the name of Rabbi Yishmael (ר' ישמעאל) said a certain student before Rabbi Akiva (ר' עקיבא),' it is none other than Rabbi Meir (ר' מאיר), who served both Rabbi Yishmael and Rabbi Akiva." And similarly, we say generally: Rav Hai (רב האי) said, "That I am sharper than my colleagues is because I saw Rabbi Meir from behind; had I seen him from the front, I would be even sharper." It was taught: His name was not Rabbi Meir, but rather Rabbi Meyasha (ר' מייאשא) was his name; and why was his name called Rabbi Meir? Because he illuminated the eyes of the Sages in halacha. And his name was not Rabbi Nehorai (ר' נהוראי), but rather Rabbi Nehemiah (ר' נחמיה) was his name; and some say his name was Rabbi Elazar ben Arach (ר' אלעזר בן ערך); and why was his name called Rabbi Nehorai? Because he illuminates the eyes of the Sages in the Mishnah (משנה). And we say that even the First Man (אדם הראשון) rejoiced in the Torah of Rabbi Akiva when the Holy One, blessed be He (הקב"ה), showed him every generation and its Sages.

    ורבי דוסא בן הרכינס קאמר ליה אנת הוא עקיבא בן יוסף ששמו הולך מסוף העולם ועד סופו. וחכם שבכל תלמידיו ר' מאיר היה דאמר' א"ר אחא בר חנינא גלוי וידוע לפני מי שאמר והיה העולם שאין בדורו של ר' מאיר כמותו כו'. ונקט ר' מאיר בהילכתא אורחא דר' עקיבא. ורבי כתב דברי היחיד והמרובים דתנן במסכת עדיות דתנן אמר ר' יהודה למה הוזכרו דברי היחיד בין המרובים לבטלן שאם יאמר לך אדם כך אני מקובל אומר לו כדברי איש פלוני שמעת(י):

    And Rabbi Dosa ben Harkinas (רבי דוסא בן הרכינס) said to him: "Are you Akiva ben Yosef (עקיבא בן יוסף) whose name goes from one end of the world to the other?" And the wisest of all his students was Rabbi Meir (ר' מאיר), as Rabbi Aha bar Hanina (ר' אחא בר חנינא) said: "It is revealed and known before the One who spoke and the world came into being that there was none in the generation of Rabbi Meir like him..." etc. And Rabbi Meir took the path of Rabbi Akiva (ר' עקיבא) in halacha. And Rabbi (רבי) wrote the words of the individual and the majority, as we learned in Tractate Eduyot (עדיות): "Rabbi Yehudah (ר' יהודה) said, 'Why were the words of the individual mentioned among the majority to nullify them? So that if a person says to you, "Thus I have received," one can say to him, "You heard it according to the words of that specific individual."'"

    ואנן לא ידעינן הי משנה כתב רבי ברישא אלא ודאי פירקי דכל מסכתא ומסכתא חד בתר חד כדמסירי לן כתבינון דאמר ר' הונא בחדא מסכתא לא אמרי' אין סדר למשנה בתרתי מסכיתא אמרינן אין סדר למשנה. והיכא דאשכחן מחלוקת ואחר כך סתם בחדא מסכתא אמרינן הלכה כסתם [משום] דיש סדר למשנה אבל בתרתי מסכייתות לא אמרינן [מחלוקת ואחר כך סתם הלכה בסתם משום דבתרתי מסכתות לא אמרינן] יש סדר למשנה דלא ידעינן הי כתב רבי ברישא:

    And we do not know which Mishnah (משנה) Rabbi (רבי) wrote first, but certainly the chapters of each and every tractate were arranged one after another, as they were handed down and written for us. As Rav Huna (ר' הונא) said: "Within one tractate we do not say 'there is no chronological order to the Mishnah'; between two tractates we do say 'there is no chronological order to the Mishnah.'" And where we find a dispute and afterward an anonymous ruling in one tractate, we say the halacha follows the anonymous ruling because there is an order to the Mishnah; but between two tractates, we do not say [a dispute and afterward an anonymous ruling means the halacha follows the anonymous ruling, because between two tractates we do not say] there is an order to the Mishnah, for we do not know which one Rabbi wrote first.

    וששאלתם מאי טעמא הקדימו פורים לשקלים אנן הכי מתנינן שקלים ואח"כ פורים. וסוכה מקמי יום טוב. ובתר הכין ראש השנה. ואפשר למיכתבינהו ר' בחילוף מיהו אית לך למימר דאקדים שבת לעירובין הואיל וחשובה שבת טובא. ובתרה פסחים הואיל ואיתיה ראשון לכל המועדים. ובתריה שקלים שהוא מלפניו והדר מעניינא דעירובין. ובתר שבת והדר לענין שבת. ותנא סדר יומא משום דכשבת דמי ואע"ג דבסידור שנה איתיה אחר ראש השנה עדי מן ראש השנה דראש השנה כמעביר יום לפני הכיפורים דמי. ובתר יום הכיפורים סוכה דחג גדול איתיה וכפסח דמי. ואחריה יום טוב דכגון דשבת הוא. ובתרה ראש השנה. ובתרה תענית דדמיא קצת ליום טוב דכגון שאסורין בעשיית מלאכה ומיסתברא לעשות' למיכתב תעניות בתר ראש השנה דבראש השנה ותעניות צריכין אנן למיבעי רחמי. וכמה דמפרשינן רגילין רבנן למיתנא ולמיכתבינהו ואי אית דניחא ליה לאקדומי או לאחורי הרשות בידו כדאמרינן לעיל דבתרתי מסכתות אמרינן אין סדר למשנה דלא ידעינן הי כתבה רבי ברישא. ואית מסכתא דאמרינן תנא אמאי קאי כגון שבועות אחר מכות. ובברכות אמרינן תנא היכא קאי דקתני מאימתי:

    And regarding what you asked: "What is the reason they placed Purim (פורים) before Shekalim (שקלים)?" We teach Shekalim and then Purim. And Sukkah (סוכה) before Yom Tov (יום טוב). And after that Rosh Hashanah (ראש השנה). And it was possible for Rabbi (ר') to write them in a different order. However, you can say that he preceded Shabbat (שבת) to Eruvin (עירובין) because Shabbat is very important. And after it Pesachim (פסחים), because it is the first of all the festivals. And after it Shekalim, which chronologically precedes it, and then he returns to the matter of Eruvin. And after Shabbat he returns to the matter of Shabbat. And he taught the order of Yoma (יומא) because it is similar to Shabbat, and even though in the order of the year it is after Rosh Hashanah, it is greater than Rosh Hashanah, since Rosh Hashanah is like a passing day before Yom Kippur (יום הכיפורים). And after Yom Kippur is Sukkah, which is a great festival and is like Pesachim. And after it is Yom Tov, which is like Shabbat. And after it is Rosh Hashanah. And after it is Ta'anit (תענית), which is somewhat like Yom Tov, since they are forbidden in doing work, and it makes sense to write Ta'anit after Rosh Hashanah, because on Rosh Hashanah and fast days we need to beg for mercy. And as we explained, the Rabbis were accustomed to teaching and writing them; and if someone wants to advance or delay them, he has permission, as we said above that between two tractates we say "there is no chronological order to the Mishnah," because we do not know which one Rabbi wrote first. And there is a tractate where we say, "Where does the Tanna (תנא) stand?" such as Shevuot (שבועות) after Makkot (מכות). And in Berachot (ברכות) we say, "Where does the Tanna stand that he teaches 'From when'?"

    וששאלתם לענין התוספתא אם לאחר המשנה נכתבה או בזמן אחד עמה. ודאי ר' חייא [תרצה] מיהו לא מסתיימא אי ביומיה דר' או בתריה אבל בלא ספק דבתר דמיתרצו הלכות המשנה איתרצא תוספתא אבל לא אפשיט לן אי ביומיה דר' נח נפשיה דר' חייא אי בתריה כדשקלינן וטרחינן בפר' הנושא בכתובות. ומיהו אמרי רבנן דביומיה דר' איתקין ברייתא והוו איתניין ביה מדרשיה מן ההיא דשמעתא קמייתא דחגיגה דהוו הנהו אילמי דהוו בשיבבותיה דרבי בני אחתיה דר' יוחנן בן גודגדא ואמרו לה בני ברתיה דר' יוחנן בן גודגדא דכל אימת דהוה עייל רבי לבי מדרשא הוו עיילין ויתבין קמיה מרחשן שיפותיהו בעא רחמי עלייהו ואיסתסיא ואישתכח דגמירי הילכתא וסיפרא וסיפרי ותוספתא וכוליה תלמודא:

    And regarding what you asked concerning the Tosefta (תוספתא), whether it was written after the Mishnah (משנה) or at the same time with it: Certainly, Rabbi Hiyya (ר' חייא) arranged it. However, it is not definitively resolved whether it was in the days of Rabbi (ר') or after him, but without a doubt, after the halachot of the Mishnah were arranged, the Tosefta was arranged. But it is not resolved for us whether Rabbi Hiyya passed away in the days of Rabbi or after him, as we discuss and deliberate in the chapter "HaNose" in Ketubot (כתובות). However, the Rabbis say that in the days of Rabbi the Baraita (ברייתא) was established, and his midrashim were taught from it, based on that first teaching of Hagigah (חגיגה) regarding those deaf-mutes who were in Rabbi's neighborhood, the sons of the sister of Rabbi Yohanan ben Gudgada (ר' יוחנן בן גודגדא). And the sons of the daughter of Rabbi Yohanan ben Gudgada said that whenever Rabbi would enter the study hall, they would enter and sit before him, moving their lips. He prayed for mercy upon them and they were healed, and it was found that they had learned Halacha (הילכתא), Sifra (סיפרא), Sifrei (סיפרי), Tosefta, and the entire Talmud (תלמוד).

    ודאמריתן מה ראה ר' חייא לכתבה ואמאי לא כתבה רבי. תשובה. רבי [עיקרי] תקן כגון כללות ולישנא [קייטא] דאפי' מחדא מילתא איכא למיגמר מינה תילי תלים. ואתא ר' חייא אפשיט בברייתא ומילי מפשיטנא ובלשון ארוכה כל כמה דאימעיט ליבא. וכל הברייתות מן המשנה למד וכדאמרינן אילפא תלא נפשיה באיסקריא דספינתא אמר אי איכא דבעי מנאי מילתא ברבי ר' חייא וברבי ר' אושעיא ולא משפיטנא ליה ממתינא [נ"א ממתניתא] נפילנא מאיסקריא וטבענא אלמא כל מה דאית ברבי ר' חייא וברבי ר' אושעיא דאינון ברייתא אית למשפטיה ממתניתן.

    And what you said: "What did Rabbi Hiyya (ר' חייא) see fit to write it, and why did Rabbi (רבי) not write it?" Answer: Rabbi essentially established it like general rules and concise language, such that even from one matter, one can deduce from it mounds upon mounds of laws. And Rabbi Hiyya came and expanded upon it in the Baraita (ברייתא), explaining matters in lengthy language, as much as the heart had diminished. And he learned all the Baraitot from the Mishnah (משנה), as we say: Ilfa (אילפא) hung himself from the mast of the ship and said, "If there is anyone who can ask me a matter from the Baraitot of Rabbi Hiyya and Rabbi Oshaya (ר' אושעיא) and I cannot resolve it from our Mishnah, I will fall from the mast and drown." Thus, everything that is in Rabbi Hiyya and Rabbi Oshaya, which are Baraitot, can be deduced from our Mishnah.

    And even though the general rule between Rabbi Meir (ר' מאיר) and Rabbi Yose (ר' יוסי) is that the halacha follows Rabbi Yose, where Rabbi (רבי) recorded an anonymous ruling like Rabbi Meir, we act according to the anonymous ruling. But where Rabbi explicitly stated their dispute, the halacha follows Rabbi Yose. And if Rabbi Hiyya (ר' חייא) saw the reasoning of Rabbi Meir and recorded an anonymous ruling in the Baraita (ברייתא) like him, we do not accept it from him. As Rabbi Nahum (ר' נחום), the servant of Rabbi Abbahu (ר' אבהו), asked: "An anonymous ruling in our Mishnah and a dispute in the Baraita—what is the rule?" He said to him: "The halacha follows the anonymous ruling of our Mishnah." "A dispute in our Mishnah and an anonymous ruling in the Baraita—what is the rule?" He said to him: "If Rabbi did not teach it, from where did Rabbi Hiyya get it?" Because Rabbi Hiyya was a student of Rabbi, and Rabbi Hiyya's learning was from Rabbi, and Rabbi Hiyya only had what Rabbi taught him. And each of the great masters had a Baraita of their own on every tractate, as we say Rav Sharvya (רב שרבייא) taught in Kiddushin (קידושין) of the house of Levi (לוי). And these Baraitot that Rabbi Hiyya and Rabbi Oshaya (ר' אושעיא) arranged are superior and the primary ones. As we say: Any Baraita that is not taught in the house of Rabbi Hiyya and Rabbi Oshaya is not a Baraita, and we do not raise objections from it in the study hall. And in the great yeshivot they were written according to all the Sages of the generation, and from them we say in the Talmud (תלמוד) "Tanu Rabanan" (תנו רבנן). But "Tani Bar Kappara" (תני בר קפרא), "Tani of the house of Rabbi Shmuel" (תני דבי רבי שמואל), "Tani of the house of Rabbi Yishmael" (תני דבי ר' ישמעאל), and "Tani of the house of Rabbi Elazar ben Yaakov" (תני דבי ר' אלעזר בן יעקב)—all of these Baraitot were not established for everyone to study as the Baraitot of Rabbi Hiyya and Rabbi Oshaya were established, and we do not say concerning them "Tanu Rabanan," but rather "Tanya" (תניא) and "Tana" (תנא) and "Tuna" (תונא).

    Sifra (סיפרא) and Sifrei (סיפרי) were not written at the time of our Mishnah (משנה) but afterward. As we say in Yevamot (יבמות): Rabbi Yohanan (ר' יוחנן) said to Rabbi Shimon ben Lakish (ר' שמעון בן לקיש), "I saw Ben Pedat (בן פדת) sitting and expounding like Moses from the mouth of the Almighty." He said to him, "It is not his, it is a Baraita (מתניתא)! And where did he learn it? In Torat Kohanim (תורת כהנים)." Rabbi Yohanan went out as a Tanna for three days and reasoned it for a hundred months. And after that, the Tosefta (תוספתא), Sifra, and Sifrei were established. And wherever the Amoraim (אמוראי) disagree, and the general course follows one of them, and a Baraita is taught like the other, we act according to the one whose teaching aligns with the Baraita. And other minor Baraitot are not for issuing rulings from them, such as Hilchot Derech Eretz (הלכות דרך ארץ) and Aggadot (הגדות). And where Rabbi (ר') saw the words of an individual and they seemed correct to him, he taught them in the plural language of Rabbi Meir (ר' מאיר) in "Oto V'et Beno" (and he taught them in the language of the Sages), and the words of Rabbi Shimon (ר' שמעון) in the covering of the blood, and he taught them in the language of the Sages. Rabbi and Rabbi Natan (ר' נתן) are the end of the Mishnah, as we say there: Shmuel Yarchina'ah (שמואל ירחינאה) saw the book of the First Man (אדם הראשון) that the Holy One showed him, every generation and its Sages, every generation and its expounders, and it was written in it: Rabbi and Rabbi Natan are the end of the Mishnah.

    אשי ורבינא סוף הוראה. רב ור' חמא דרא דאמרינן אמר ר' יוחנן נהירנא כד הוה יתיבנא שבע עשרין שורין אחוריה דרב ורב קמיה דר' והוו זיקוקין דנור נפקין מפומיה דר' לפומיה דרב ומפומיה דרב לפומיה דר' ולא הוינא ידע מה אינון אמרין. ובכמה מקומות אמרי' רב תנא הוא ופליג. וכד אתא דרא אחרינא אימעיט ליבא ומילי דהוו פשיטן לראשונים אריכין הלשון לתלמידיהם בדרא בתרא כמו פירושים כדאמרי' בעירוב שנתנו באילן. יתיב ר' חייא בר אבהו ורב אסי כו' ואמרי' בסיפא אמר להו רב נחמן ישר וכן אמר שמואל אמרי ליה פתריתו בה כולי האי כו' ודאמרינן רב אשי ורבינא סוף הוראה בתר הכי אע"ג דהוראה לא הוות איקרו הנך רבוותא רבנן סבוראי כגון רב ניחומי ורבה יוסי ורב אחאי רב עינא ורב סימנא. ודבתרייהו קרינן רבנן סבוראי אותן שהיו בתר רבינא כו':

    Ashi (אשי) and Ravina (רבינא) are the end of instruction. Rav (רב) and Rabbi Hama (ר' חמא) were a generation, as we say: Rabbi Yohanan (ר' יוחנן) said, "I remember when we were sitting seventeen rows behind Rav and Rav was before Rabbi (ר'), and sparks of fire were flying from the mouth of Rabbi to the mouth of Rav, and from the mouth of Rav to the mouth of Rabbi, and I did not know what they were saying." And in several places we say: Rav is a Tanna (תנא) and can disagree. And when another generation came, the heart diminished, and matters that were simple to the early ones required lengthy language for their students in the later generation, like commentaries, as we say in Eruvin (עירוב) regarding the one who placed his Eruv in a tree. Rabbi Hiyya bar Abbahu (ר' חייא בר אבהו) and Rav Assi (רב אסי) sat... and we say at the end, Rav Nahman (רב נחמן) said to them, "Straight." And so said Shmuel (שמואל), they said to him, "Did you interpret it so much..." And that which we say "Rav Ashi and Ravina are the end of instruction," after this, even though there was no instruction, those rabbis were called the Saboraic Rabbis (רבנן סבוראי), such as Rav Nihumi (רב ניחומי) and Rabba Yosi (רבה יוסי) and Rav Ahai (רב אחאי), Rav Eina (רב עינא) and Rav Simna (רב סימנא). And after them, we call the Saboraic Rabbis those who were after Ravina, etc.

    In the exits of Shabbat (שבת) we say Hillel (הילל), Gamliel (גמליאל), and Shimon (שמעון); this is Rabban Gamliel the Elder (רבן גמליאל הזקן) and Shimon his son, who conducted their presidency before the Temple for a hundred years. And after Rabban Shimon ben Gamliel (רבן שמעון בן גמליאל) who was killed, there was Rabban Yohanan ben Zakkai (רבן יוחנן בן זכאי), who was at the time of the destruction of the Temple. And when they brought him out to Vespasian (אספסיינוס), his students Rabbi Eliezer (ר' אליעזר) and Rabbi Yehoshua (ר' יהושע) entered with him, and he requested from Vespasian the dynasty of Rabban Gamliel, as we say in Gittin (גיטין). And after that, Rabban Shimon ben Gamliel who was killed, there was Rabban Gamliel his son. And this Rabban Gamliel was the Nasi (נשיא) in Yavneh (יבנה), and Rabbi Yehoshua was the Head of the Court. And since he pained Rabbi Yehoshua three times, they removed him and appointed Rabbi Elazar ben Azariah (ר' אלעזר בן עזריה), who was wise, rich, and tenth in descent to Ezra the Scribe. And then they returned it to Rabban Gamliel, and they did not remove Rabbi Elazar ben Azariah, but Rabban Gamliel taught two Sabbaths and Rabbi Elazar ben Azariah one Sabbath, as explained in the Gemara of the morning prayer. And after Rabban Gamliel the latter, was Rabban Shimon ben Gamliel his son. And after him, Rabbi (ר') his son in Tzippori (ציפורי) and Beit Shearim (בית שערים).

    שמואל ומר עוקבא בחד דרא הוו דאמרינן שמואל ומר עוקבא כי הוו יתבי וגרסי הוה יתיב מר עוקבא קמיה דשמואל בארבע אמות וכי הוו ייתבי בדינא הוה שמואל יתיב קמיה דמר עוקבא בד' אמות. ורב נחמן בר רב הונא שכיב ונפל שמדא וגזר דיזדגרד לבטולי שבתא ומלך במחסיה רב טביומי דהוא מר בר רב אשי כו'. שמעינן מן ראשונים ובסיפ[רי] זכרוניהם דבעו רחמי ובלעיה תנינא ליזדגרד מלכא מבית משכבו ובטל הגזרה כו'. שכיב רב סמא דתן בריה דרבא. ובתרה מלך רבה ורב יוסף ומבית וביומיה סוף הוראה ואיסתתם תלמודא והוו רבנן סבוראי.

    Shmuel (שמואל) and Mar Ukva (מר עוקבא) were in one generation, as we say: Shmuel and Mar Ukva, when they sat and learned, Mar Ukva would sit before Shmuel at four cubits, and when they sat in judgment, Shmuel would sit before Mar Ukva at four cubits. And Rav Nahman bar Rav Huna (רב נחמן בר רב הונא) passed away, and a persecution fell, and Yazdgerd (יזדגרד) decreed to abolish Shabbat, and Rav Tavyumi (רב טביומי), who is Mar bar Rav Ashi (מר בר רב אשי), reigned in Mahoza (מחסיה). We hear from the early ones and in the book of their memories that they begged for mercy, and a snake swallowed King Yazdgerd in his bedchamber, and the decree was abolished. Rav Sama (רב סמא) son of Rava (רבא) died. And after him reigned Rabba (רבה) and Rav Yosef (רב יוסף) and from the house, and in his days was the end of instruction, and the Talmud (תלמוד) was sealed, and there were the Saboraic Rabbis (רבנן סבוראי).

    And these are their names: Rav Ahai of Bei Hatim (רב אחי מבי חתים). Rav Geviha of Argiyot (רב גביאה מאגריותא). Rav Ahai bar Rav Nehilai (רב אחי בר רב נחילאי). Rabana Sama bar Rabana Yehuda (רבנא סמא בר רבנא יהודה). Rav Shmuel of Pumbedita (רב שמואל מפומבדיתא). Ravina bar Umitza (רבינא בר אומצא) and Rav Ahadboi (רב אחדבוי). Rav Ketina (רב קטינא) and Mar Zutra (מר זוטרא) sons of Rav Hanina (רב חנינא). And in their days Mahomet (מחומד) went forth in the year 928 [Seleucid era], and from the creation of the world there are today 4744 years, and to the Greek counting 1195 years. 172 years after the destruction, 4000 were completed, and there were Tannaim (תנאים) before the destruction of the Temple for 180 years. Hillel the Elder (הלל הזקן) and Rabban Yohanan ben Zakkai (רבן יוחנן בן זכאי) and Rabbi Akiva (ר' עקיבא) lived 120 years, and Rabbi Hiyya (ר' חייא) 300 years. And Rabbi Yonatan (ר' יונתן) the end of action. Rav Huna (רב הונא) and Rav Nahman (רב נחמן), the halacha follows Rav Nahman in civil laws. Rav Ashi (רב אשי) and Rav Kahana (רב כהנא), the halacha follows Rav Kahana. Rav Ashi and Ravina (רבינא), the halacha follows Rav Ashi, and the halacha follows Mar bar Rav Ashi (מר בר רב אשי) in the entire Talmud except for reversing an oath and writing a ruling. And after him Mar Rav Rabba (מר רב רבה), who enacted in his days to give a get immediately to certify, unlike the teaching of the daughter-in-law of Rav Zevid (רב זביד) etc. And Mar bar Rav Huna (מר בר רב הונא) stood up, Mar HaLevi bar Mar Yitzhak (מר הלוי בר מר יצחק). And in his days they enacted to collect from a debtor and ketubah from orphans from movable property.

    והוא היה עם מר רב הונא מר הלוי ומר רב מנשה גאוני פומבדיתא כשתיקנו כתובה ממטלטלי כו'. על ידי חלום אדברוהי לרב יוסף גאון והוה חסיד טובא וזקן מאד ואיתמר דהוה אתי אליה גביה זכור לטוב יתיב במתיבתא דיליה בכולהי יומיה. יומא חד אמר להו לרבנן כדסב ואישטיף ארווחו ליה לגברא סבא דאתא לי' ולא חזו רבנן אדם וידעו דאליהו הוה וארווחו טובא. כל היכא דתשכח קמאי דפליגי כגון רב ושמואל ותשכח בתראי דפליגי כל ההיא הילכתא כגון אביי ורבא או בתראי אחריני הילכתא כוותייהו. ואני יוסף שמעתי כי טעות סופר הוא אלא כן הוא בדמיפך שבועה כי ודאי בזו הלכה כמותו. אני רב יוסף שבתלמוד שהרי מן רבנן סבוראי הוה כמה וכמה שנים פי' אינו רב שבתלמוד מן רבנן סבוראי הוה. וסמכיניה להאיי בננו באבות בית דין מן שיעור ב' שנין יהא רעוא מן קמי קודשא ברי' הו' לשווייתנא חשובים עם החיים ועם הכת' לחיים ויזכי יתנא לדבורי ישראל כהוגן וייתי משיחא בר דוד השתא בעגלה ובזמן קריב בחייכון ובחיינא אמן:

    And he was with Mar Rav Huna (מר רב הונא) Mar HaLevi (מר הלוי) and Mar Rav Menashe (מר רב מנשה), the Geonim of Pumbedita (פומבדיתא), when they enacted ketubah from movable property. Through a dream, they spoke to Rav Yosef (רב יוסף) the Gaon, and he was very pious and very old, and it is said that Eliyahu (אליהו), remembered for good, would come to him and sit in his yeshiva with him all his days. One day he said to the rabbis, when he grew old and weak, "Make room for the old man who has come to him," and the rabbis did not see a man, and they knew it was Eliyahu, and they made much room. Wherever you find early ones who disagree, such as Rav (רב) and Shmuel (שמואל), and you find later ones who disagree, all that halacha, such as Abaye (אביי) and Rava (רבא), or other later ones, the halacha follows them. And I, Yosef, heard that it is a scribal error, but rather it is so regarding reversing an oath, because certainly in this the halacha follows him. I, Rav Yosef, who is in the Talmud (תלמוד), for from the Saboraic Rabbis (רבנן סבוראי) he was many years; meaning, he is not the Rav in the Talmud, but from the Saboraic Rabbis he was. And we rely on this appointing our son Hai (האיי) as the Head of the Court from the age of two years, may it be the will before the Holy One, blessed be His name (קודשא בריך הוא), to make us considered among the living and written for life, and may He merit us to lead Israel (ישראל) properly, and may the Messiah, son of David (משיחא בר דוד), come now, swiftly, and in a near time, in your lifetimes and in our lifetimes, Amen.
